Terms of Service for Ultrasonic Fiber Corporation

These Terms of Service (“Agreement”) govern the use of the internet broadband services (the “Services”) provided by Ultrasonic Fiber Corporation (“we,” “us,” or “our”) to you, the customer (“you” or “Customer”). By using our Services, you agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree to these terms, you should not use our Services.

1. Services Provided

Ultrasonic Fiber Corporation provides broadband internet services, including but not limited to high-speed fiber-optic internet, to residential and commercial customers. We may modify, suspend, or discontinue services at any time, with notice to you.

2. Account Creation and Responsibilities

    •    Account Registration: To access our Services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and password and for all activity that occurs under your account.

    •    Customer Responsibilities: You agree to use our Services in compliance with all applicable laws, regulations, and this Agreement. You are responsible for ensuring that your use of the Services does not violate the rights of others or harm the network and infrastructure of Ultrasonic Fiber Corporation.

3. Acceptable Use Policy

You agree not to use our Services for any unlawful or abusive activities, including but not limited to:

    •    Illegal activities: Engaging in or facilitating activities that violate laws or regulations, including hacking, fraud, or distributing illegal content.

    •    Network Disruption: Using our Services in a manner that disrupts or damages the network, infrastructure, or services of Ultrasonic Fiber Corporation or any third party.

    •    Spamming and Malware: Sending unsolicited commercial messages (spam), spreading viruses, or engaging in activities that harm or disrupt others’ devices or networks.

    •    Excessive Use: While we strive to offer unlimited bandwidth, excessive or abusive usage that disrupts the experience of other users may result in throttling, suspension, or termination of service.

4. Billing and Payment

    •    Service Fees: By subscribing to our Services, you agree to pay all applicable fees for the Services as specified in your subscription plan. Payment terms and rates may be changed, but you will receive prior notice of any changes.

    •    Billing Cycle: You will be billed monthly, unless otherwise specified. Payments are due in advance, and late payments may result in penalties or suspension of Services.

    •    Payment Methods: We accept various payment methods, including credit cards, direct debit, and other online payment methods as specified on our website.

    •    Taxes: You are responsible for paying any applicable taxes, fees, or charges related to the Services in your jurisdiction.

5. Service Availability and Limitations

    •    Network Reliability: While we strive to provide reliable and consistent service, you understand that no service is guaranteed to be error-free, uninterrupted, or available at all times. We are not responsible for outages, slowdowns, or other service interruptions caused by third parties or events outside of our control.

    •    Service Interruptions: In the event of a service outage or planned maintenance, we will make reasonable efforts to notify you in advance. However, you acknowledge that such interruptions may occur from time to time.

6. Data Privacy and Security

    •    Data Protection: We use reasonable efforts to protect your data from unauthorized access or disclosure. However, no system is completely secure, and we cannot guarantee the protection of your data against breaches or unauthorized access.

    •    CPNI: In compliance with the Communications Act and applicable laws, we may use and protect your Customer Proprietary Network Information (CPNI) in accordance with our CPNI policy.

7. Term and Termination

    •    Term: This Agreement begins on the date you subscribe to the Services and continues until terminated by you or us.

    •    Termination by You: You may terminate your subscription at any time by contacting customer service. Termination will be effective at the end of the current billing cycle.

    •    Termination by Us: We may suspend or terminate your access to Services for violation of this Agreement, failure to pay fees, or illegal activity. We will provide notice if termination is due to non-payment or other issues.

    •    Effect of Termination: Upon termination, you must return any equipment provided by us, and any outstanding fees or charges will become immediately due and payable.

8. Limitation of Liability

To the fullest extent permitted by law, Ultrasonic Fiber Corporation shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data or business interruptions, arising out of or in connection with the use or inability to use the Services.

9. Indemnification

You agree to indemnify and hold harmless Ultrasonic Fiber Corporation, its affiliates, officers, employees, and agents from any claims, damages, or liabilities arising from your use of the Services or violation of this Agreement.

10. Amendments

We reserve the right to modify, update, or change these Terms of Service at any time. You will be notified of significant changes, and your continued use of the Services constitutes your acceptance of those changes.

11. Governing Law

This Agreement shall be governed by the laws of the state of Utah. Any disputes arising from this Agreement will be resolved in the appropriate courts located in Utah.
